Terms and Conditions

These Terms and Conditions (“Terms”) set out the agreement between Showtime Circus Ltd (“we”, “us”, “our”) and you, the registered user of our mobile and/or web application (“App”). By creating an account or using our App, you agree to be bound by these Terms. If you do not agree, you must not use the App.

 

1. Eligibility

1.1 The App is currently intended for use by:

• Approved Showtime Circus franchisees, licensees, and teachers; and
   

• Parents/guardians over 18 years old who are responsible for students engaging with Showtime Circus activities.
  1.2 By registering, you confirm that you are legally capable of entering into a binding contract under the laws of England & Wales.
   

 

2. Services Provided

2.1 Through the App, you may have access to:

• Video tutorials, training resources, and downloadable materials;
   

• Online courses and CPD training;
   

• Merchandise sales; and
   

• Event and course bookings.
  2.2 Some features are free; others require payment or a subscription. Prices are set out within the App and may change at our discretion.
   

 

3. Account Registration & Security

3.1 You must register an account to access most features. You agree to provide accurate and complete information at all times.
3.2 You are responsible for keeping your login details secure and must not share them with anyone outside your approved team or household.
3.3 If we reasonably believe your account is being misused or accessed without permission, we may suspend or terminate it without notice.

 

4. Intellectual Property

4.1 All content in the App, including videos, training materials, text, images, branding, and logos, is the exclusive property of Showtime Circus Ltd or its licensors and is protected by UK and international intellectual property laws.
4.2 You are granted a limited, non-exclusive, non-transferable licence to access and use the content for your own personal or authorised business use only.
4.3 You must not:

• Share, copy, record, resell, or distribute our content without written permission;
   

• Remove copyright notices or branding;
   

• Use our trademarks without approval.
   

 

5. Payments, Refunds & Subscriptions

5.1 Payments for courses, merchandise, or subscriptions are processed by third-party payment providers (e.g., Stripe, PayPal). We are not responsible for errors caused by these providers.
5.2 Unless otherwise stated, all payments are non-refundable. Course purchases are final once accessed.
5.3 Subscriptions automatically renew unless cancelled via your account before the renewal date.

 

6. Health & Safety Disclaimer

6.1 Circus, aerial, and acrobatic activities carry inherent risks. By using our training materials or attempting any skills shown, you confirm that:

• You are participating voluntarily and at your own risk; and
   

• You have sought appropriate medical advice before beginning any new physical activity.
  6.2 Showtime Circus Ltd is not liable for any injury, loss, or damage arising from your participation in activities, whether online or in person.
  6.3 You are responsible for ensuring a safe environment and appropriate supervision when children are taking part.
   

 

7. Data Protection & Privacy

7.1 We collect, store, and process personal data in accordance with the UK GDPR and our Privacy Policy (available [link]).
7.2 We may use tracking and analytics to improve our services.
7.3 We may share your information with third-party service providers (such as payment processors, video hosting platforms, or analytics providers) where necessary to deliver the App.

 

8. Prohibited Conduct

You must not:

• Share your login details outside your approved user group;
   

• Copy or distribute content without permission;
   

• Misuse the App for unlawful purposes;
   

• Upload or transmit harmful code or spam.
   

 

9. Termination

9.1 We may suspend or terminate your account immediately if you breach these Terms, misuse the App, or act in a way that may damage our reputation.
9.2 On termination, your licence to use our content ends immediately and you must delete any downloaded materials.

 

10. Limitation of Liability

10.1 To the fullest extent permitted by law, we exclude all liability for any loss, injury, or damage arising from your use of the App, except where caused by our negligence or wilful misconduct.
10.2 Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability which cannot be excluded by law.

 

11. Changes to These Terms

We may update these Terms from time to time. If changes are significant, we will notify you by email or via the App before they take effect. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.

 

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
